HIPAA Patient Rights Checklist

The ClinicNerds divide HIPAA into two parts:

  1. Protected Health Information (PHI)
  2. Patient Rights
This is an overview checklist for Patient Rights. HIPAA rules give patients the right to make eight different types of requests. The requests guarantee patients more control in the healthcare processes. Small clinics need to prepare for when a patient makes a request.

Patient Rights

Develop policies and procedures for patients that make a Patient Right request.

  • Patient Right #1 - Get a copy of medical record

  • Patient Right #2 - Request to correct medical record

  • Patient Right #3 - Request confidential communications

  • Patient Right #4 - Ask the clinic to limit what is shared

  • Patient Right #5 - Get a list of those with whom the clinic shared information

  • Patient Right #6 - Get a copy of the clinic's Notice of Privacy Practices

  • Patient Right #7 - Choose someone to act for you

  • Patient Right #8 - File a complaint with the HIPAA Police

  • Patient Rights 3, 4, 5, 7 are administrative nightmares for the clinic

  • Develop special workflow policies and procedures for Patient Rights 3, 4, 5, 7

  • Document all policies and procedures in the HIPAA Notebook

  • Train the workforce in the new Policies and Procedures
